Please read the following terms and services carefully as it sets out the terms of a legally binding agreement between customer and AvivaHost.
We are an independent institution that facilitates you hosting services on the Internet. We only have control over the product and services we provide directly and are not liable for your actions, the actions of third-party service providers, or the actions of individuals who use your authority of such products and services i.e. End Users.
AvivaHost provides a range of various services and products to its users, which are collectively referred to in these TOS as "Services".
Any service whether paid, discounted or part of the package falls under the term "Services" and subject to the discretion of AvivaHost policies.
Services Offered AvivaHost offers a number of different products and services, including but not limited to those listed below. These TOS and our Policies apply to all of our Services, whether listed or not listed.

AvivaHost reserves the sole right to refuse the services in any of the following activities mentioned or the activities seem inappropriate in our ethos.
a> Adult Materials - Sites that contain pornographic content, erotic images, escort services, child pornography, hosting adult thumbnail galleries/banner exchanges. or any type of obscene content will be suspended immediately without any notice.
b> Unlawful Material - Any copyrighted content including Audio/video/Music/Image which violates the authority of the original creator.
c> Warez - It includes Pirated softwares, Illicit copies, Hacking, Password decoding, Emulators, Roms, CD-Keys, cracks, passwords, serial numbers, Internet viruses, worms or Trojan horses, engaging in denial of service attacks, or hosting content that is int
d> Games - We strictly prohibited any type of gaming services on our servers.
e> IRC Host - IRC scripts/bots, IRCD (IRC servers), AutoSurf/PTC/PTS/PPC sites are strictly prohibited.
g> IP scanners, Bruteforce Programs/Scripts/Applications;
h> Mail Bombers/Spam Scripts - Mail bombers which contain mass mailing, zip bombing, list linking that attacked the targeted email address with large volumes of mails to overflow its capacity is prohibited.
i> File Dump/Mirror Scripts (similar to RapidShare);
j> Anonymous or Bulk SMS Gateways - Similar to mail bombers but contains text messaging to target with SMS. It qualifies under cyberbullying or online harassment. Such practices are strictly forbidden.
k> Websites that advocate physical violence, hate crimes, racial abuse, communal disharmony is liable to punishment under the concerned Law.
l> Websites promoting illegal activities or links to other sites that promote illegal undertakings;
m> Gambling, Online lotteries are not allowed.
n> Ponzi or Pyramid schemes, Rouge trading, Fishing fraud, Bill discounting, Demand draft fraud, prime banks programs, Bank Debentures advertising, advocating or operating High-Yield Interest Schemes.
o> cryptocurrency/bitcoin miners;
p> setting up or using (via the Service) proxies, proxy scripts/anonymizers of any kind
q> Identity theft or impersonating another user's name in an email, Usenet postings, on Internet Relay Chat (IRC), or with any other Internet service;
r> doxing, posting individual's information such as addresses and phone numbers intended to causing damage or harm to said person. This does not cover Government officials when providing contact email addresses or the representative's work phone.
s> Network hostile activities, posting links to prohibited items, facilitating a violation of our Policies, or instructing others in illegal or prohibited activities.
AvivaHost reserves the right to deem any other content or literature as "prohibited" if found to be indecent, rude, hateful content & generally unacceptable.
The customer is provided with a bandwidth limit. If he exceeds their limit then we would send an email notification. If the customer does not upgrade or buy extra bandwidth then the services will be suspended till the time he takes measures. In the event you require more bandwidth than you have, then you have to purchase additional bandwidth by upgrading your account. your account may be suspended until the next period and it would be reactivated in the following month.
Control panel generally recommended to manage and operate the VPS. All customers who have plain VPS would have to configure the user accounts, DNS, mail accounts and other such activities related to the configuration of such VPS themselves. The support team will not be accountable for this.
a> You are accountable for all the actions you performed. It's your responsibility to back up all of your User Content.
AvivaHost does not ensure any backup on users' behalf. Any loss or deletion is the user's responsibility as per the Agreement.
b> As per the User Agreement, the Client is accountable for the loss or damage of data in any circumstances. AvivaHost is not answerable in any such case.
c> Paid backup service and reseller hosting plans are covered. We take daily back-up of these clients withholding period. we take Website backup weekly withholding period of 1 Day. These backup copies will not have any mails or media files.
d> Clients who use the cPanel Backup Manager tool are advised to download the backup from the server and delete it. All backup files are removed weekly from the server without prior intimation.
We do domain name reselling. Domain name registration is acquired through a process third-party platform. You will find their terms and policy procedures on their website. Therefore we cannot guarantee that your domain name will be registered.
After registration, you must ensure your domain name does not lapse and is timely renewed and
we are not liable for any damages caused by any lapse.
We will ensure to make reasonable efforts to renew any domain names that are subject to auto-renew. However, any such renewal is your duty and we shall not have any responsibility for the failure of renewal.
It is your duty to fully scrutinize and ensure that the domain name you register does not infringe on the legal or intellectual property rights of others.
We do not crosscheck to see whether a domain name you register or use violates the rights of any third party and we strongly suggest you seek legal advice before registering any domain.
AvivaHost will try to ensure and comply with any lawful order to transfer, cancel or alter your domain name. ICANN's has a 60-day transfer lock Policy to apply to your domain name in the occurrence of any “Change of Registrant.” AvivaHost currently locks your domain name for any change involving your WhoIs information. This feature is implemented to secure your domain from any illegal attempt to transfer your domain. AvivaHost does not offer an option to opt-out of the 60-day transfer lock. Please note that the variables that trigger the 60-day transfer lock are subject to change. The current variables which trigger the 60-day lock include
1> change of First Name of the registrant,
2> change of the Last Name of the registrant,
3> change of name of the Organization,
4> change of Email of the registrant.
You are advised to see and understand ICANN’s policies for Domain Verification and other policies they enact for domain registration.
We offer 99.9% uptime assurance. We put our rational efforts into providing seamless services 24X7. However, in order to operate securely and efficiently, service and network equipment need routine maintenance and upgrades. This results in scheduled downtime and services may be unavailable for various reasons. Any service interruptions due to server maintenance by AvivaHost or by our network provider will not fall under Uptime Guarantee.
You are responsible for your actions and activities performed by you or someone using your credentials. Account access, passwords, backup, and security measures are your responsibility. AvivaHost is not liable for any damage that happened from unauthorized access.
In order to support services, you are responsible for all authorized actions taken by our support staff.
We also perform automated scans of data for security purposes and reserve the right to change permission, modify, delete files that are potentially malicious in nature.
Term i.e delivery of service will start from the effective date viz the stipulated date for payment. AvivaHost is not liable to provide perform services until payment for services made.
We insist on time-bound payments for uninterrupted services.
Term plan automatically renews for successive duration i.e. renewal period. If you wish to discontinue auto-renewal, you should notify AvivaHost by following methods,
a> Submit a cancellation a day before the starting of the new renewal period.
b> By contacting us, 10 days before with an email stating the cancellation of the renewal term.
a> Either client may terminate the services for his /her convenience by giving 15 days prior notice by mail.
We accept termination through an online cancellation form. Termination on part of convenience is liable for charges for the active renewal period.
b> We reserve the right to terminate or cancel the services with or without notice for the following reasons, - violation of any term of TOS.
- For the failure of payments.
- To avert any service interruption by the internet service providers or other network services.
- To protect probity of AvivaHost.
Upon termination, your account will be closed and all data related will be deleted. Fees and due charges should be recovered accordingly. Once the account is closed, AvivaHost has no responsibility for providing any assistance. You are responsible to download, secure and backup your data. Post-termination- You will be charged one-time access for backup of your data.
